![]() That means that in a one-party recording state, any evidence you gather can usually be introduced by the government in a criminal prosecution or you can use it in a civil case. These amendments within the Bill of Rights relate to searches and seizure, self-incrimination, and right to counsel. Interestingly, law enforcement have many more restrictions on the use of recording and GPS equipment than do civilians because if you are not a government agent you are not governed by the requirements of the Fourth, Fifth, and Sixth Amendments to the Constitution. The rule is different for video and in most jurisdictions you can pretty much do what you want and not suffer any criminal penalties, although trespass laws relating to surveillance can still apply. In about ten states, all parties must consent to any such aural recordings. ![]() That means you can “wire” a conversation between yourself and one or more other individuals to the conversation and it is perfectly legal using one of the devices shown in this article. In about forty states, it is legal to record by audio (and video) a conversation if only one party consents. Video is generally a different matter and there are few prohibitions, other than civil for an action for invasion of privacy. That means that you cannot leave a recorder to capture conversation in a meeting, for example, where you are not a party. ![]() Under its provisions, it is generally illegal to secretly place an audio recording device in a location where consent has not been obtained from at least one party present. In the U.S., the Electronic Communications Privacy Act controls at the federal, and has been largely adopted by many states. There is also an issue of federal or state jurisdiction with regard to covert recorders and electronic surveillance. The law with regard to the use of covertly obtained evidence can be broken down into two broad categories: audio and video, and whether one party or both parties to a conversation consented to the recording. Audio and video evidence is often the most damaging and persuasive. In my world, we use these tools to develop evidence in criminal cases and in civil matters ranging from medical malpractice to corporate officers offering or receiving kickbacks, or making payments to foreign officials. Video-chip technology today is so sophisticated that cameras can be secreted virtually anywhere, and unless you really know what to look for, you will likely have no idea that you are being recorded, often in high definition. So if you think you can hide, think again. Their difference is almost indistinguishable. Even Radio Shack and Brookstone offer cheap and effective recording equipment. ![]() The glasses looked like something that Clark Kent would wear at the Daily Planet in Superman, and large 8mm body recorders were required with battery packs and very limited recording times to capture the images.īrickhouse Security is only one of thousands of suppliers in this business. Our first pair of glasses with a camera embedded in the frame cost about $4,000 in 1993. ![]() Until the mid-1990s, covert body video was very difficult, even though we sometimes used small cameras and body-worn microwave transmitters to feed video to agents a few hundred feet away in surveillance vans, hotel rooms, vehicles, or other locations.ĭigital technology came along in the 1990s but it was incredibly expensive. I was responsible for technical support for felony investigations, which meant a lot of undercover recordings, especially for drug buys, corruption, frauds and many other types of investigations. They were also used by law enforcement agencies to enhance the usual poor quality of body-worn transmitters. Their small reel-to-reel recorders, known as the SNS, were used in the movie industry and worn by actors to obtain high quality audio. ![]()
